Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and HumanPanel (“HumanPanel,” “we,” “us”) and govern your use of the HumanPanel website at humanpanel.ai, the web application and related services (the “Service”).

By creating an account or using the Service you agree to these Terms, our Privacy Policy and, where it applies, our Data Processing Addendum. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization.

2. The Service

HumanPanel lets you write surveys and run them on a panel of AI-simulated respondents. For each run, the Service designs population segments (“worlds”) from your description, generates individual simulated respondents, collects their answers and produces statistics and a written summary (“Results”). We may change, add or remove features over time.

3. Simulated results

Respondents are simulated, not real people. Results are generated by AI models and are estimates intended for exploration, piloting and hypothesis generation. They may be inaccurate, incomplete or biased, and they do not measure the opinions of any real population or individual.

• Results are not professional, legal, financial, medical or political advice.
• You must not present Results as the responses of real people, as a poll of a real population, or as survey data collected from humans.
• You are responsible for how you use Results, including validating them with real research before relying on them for important decisions.
• Any resemblance between a simulated respondent and a real person is coincidental.

4. Accounts

You must be at least 18 years old to use the Service. You sign in with one-time codes sent to your email address, so you are responsible for keeping access to that mailbox secure and for activity under your account. Tell us promptly at contact@humanpanel.ai if you believe your account has been accessed without authorization.

You must provide an email address you control and keep it up to date.

5. Acceptable use

You agree not to use the Service to:

• break any law or infringe anyone's rights;
• create surveys or Results that target, profile, harass, defame or impersonate specific real individuals, or that promote discrimination, violence or hatred;
• generate sexual content involving minors, content that facilitates serious harm, or deceptive content such as fabricated polls presented as real;
• include personal data of other people, or sensitive personal data, in surveys unless you have a lawful basis and it is necessary for your purpose;
• probe, scan or test the Service's security, disrupt or overload it, scrape it, or reverse engineer it except as allowed by law;
• resell, sublicense or provide the Service to third parties as a standalone offering without our written permission.

The Service relies on third-party AI models, and you must also not use it in ways those providers prohibit. We may review content where needed to enforce these Terms, investigate abuse or comply with law.

6. Wallet, pricing and payments

Runs are paid from a prepaid wallet in your account. The current price is $99 per completed run unless a different price is shown in the Service before you start a run.

• Top-ups. You add funds through checkout pages operated by Polar, which acts as the merchant of record and processes payments and applicable taxes. Polar's terms apply to those purchases. We do not receive or store your full card details.
• Starting a run. You can start a run only if your available wallet balance covers its price. The price is reserved when the run starts and fixed for that run.
• Charging. The reserved amount is charged when the run completes. If a run fails or you cancel it before it completes, the reservation is released and nothing is charged.
• Wallet funds. Wallet balances are prepaid credit for the Service only. They do not earn interest, cannot be transferred and have no cash value.
• Refunds. To request a refund of unused wallet funds, contact contact@humanpanel.ai. Approved refunds are issued through Polar to the original payment method. If a top-up is refunded or reversed, the refunded amount is deducted from your wallet, which may make your balance negative until you add funds. Nothing in these Terms limits refund rights you have under applicable law.
• Price changes. We may change prices. Changes apply to runs started after the new price is shown and never to runs already in progress.

7. Your content and Results

You keep ownership of the surveys and other material you submit (“Your Content”) and, as between you and us, of the Results generated for you. You grant us a worldwide, non-exclusive license to host, copy, process and transmit Your Content and Results only as needed to provide, secure and support the Service, including sending them to our service providers for that purpose.

We do not use Your Content or Results to train AI models. Because Results are generated by AI, similar outputs may be produced for other users, and we cannot guarantee that Results are unique or free of third-party rights.

You are responsible for Your Content and confirm you have the rights needed to submit it. If you send us feedback, we may use it without obligation to you.

8. Our intellectual property

The Service, including its software, design, prompts and branding, belongs to HumanPanel and its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service in line with these Terms and do not transfer any ownership to you.

9. Third-party services

The Service depends on third parties, including AI model providers, Polar for payments and email and hosting providers. We are not responsible for third-party services we do not control, but we choose them carefully and describe how they handle data in our Privacy Policy.

10. Suspension and termination

You may stop using the Service at any time and ask us to delete your account by emailing contact@humanpanel.ai. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Where reasonable we will tell you first.

If we terminate your account for reasons other than your breach of these Terms, we will refund your unused wallet balance. Sections that by their nature should survive termination, including sections 3, 7, 8 and 11 to 16, survive.

11. Disclaimers

To the maximum extent permitted by law, the Service and Results are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that Results will be accurate or reliable.

12. Limitation of liability

To the maximum extent permitted by law, HumanPanel will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service or Results, even if advised of the possibility.

Our total liability for all claims relating to the Service is limited to the greater of the amounts you paid us in the 12 months before the event giving rise to the claim, or US$100. These limits do not apply where liability cannot be limited under applicable law.

13. Indemnity

You will defend and indemnify HumanPanel against third-party claims, and related losses and reasonable costs, arising from Your Content, your use of Results, or your breach of these Terms or applicable law.

14. Changes to these terms

We may update these Terms. We will change the “last updated” date and, for material changes, notify you by email or in the Service before they take effect. Continuing to use the Service after changes take effect means you accept them.

15. Governing law and disputes

These Terms are governed by the laws of the place where HumanPanel is established, without regard to its conflict-of-laws rules, and disputes will be resolved by the competent courts of that place, unless mandatory law where you live gives you the right to bring claims in your local courts. Before starting a formal dispute, please contact us at contact@humanpanel.ai so we can try to resolve it informally.

16. General

These Terms, together with the documents they reference, are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
